ایسا شخص اپیل کرے جو فریق مقدمہ نہ تھا
1.an appeal by a person who was not a party to the compromise ▬ 2007mld 331.
ڈگری رضامندی سے نہ ہوئی
2.where it is alleged that decree is not a decree passed with the consent of parties. ▬ 1994 clc 54
عدالت کےسماعت کا اختیار نہ تھ
3.where the consent decree is alleged to b invalid as for instance where court did not have jurisdiction over the subject matter.
جہاں پر راضی نامہ کی نوعیت کا تنازعہ تھا
4.where there is a dispute regarding the nature of compromise. ▬ 1977 scmr 586
جہاں پر ڈگری معاہدہ کی حدود سے باہر تھی
5.where the decree travels beyond the agreement. ▬ 1976 scmr 519
جہاں پر رضامندی حقائق کی غلطی کی وجہ سے تھی (فراڈ)
6.where the consent is given under mistake of fact or obtained by practicing fraud upon the court. ▬ 1993 mld 640
جہاں پر راضی نامہ ممکن نہ تھا
7.where there was no compromise at all. ▬ 1994 clc 54
جہاں پر حکم 23 رول 3 پر اس کی روح کےمطابق عمل نہ کیا گیا
8.where the strict requirements of O.23 R.3 are not satisfied. ▬ 1989 scmr 1752
